The Family and Medical Leave Act (SB 831) provides the opportunity for qualified employees to take up to 12 weeks of unpaid family leave. The employee must have been employed for at least 1 year and worked at least 1,250 hours.
Employees may request family leave for the following events:
- Birth of a child
- Adoption of a child
- Serious health condition of employee's child, spouse, parent, or spouse's parent
- Serious health condition of the employee
Documentation must be provided to substantiate the existence of whatever category of family leave is requested. Leave is unpaid unless the supervisor agrees to allow the employee to utilize accrued vacation or sick leave. Family Leave for less than a two-week period should be reported on a time sheet or Report of Absence form. All requests for Family Leave should be made in writing approximately 30 days prior to the leave in the case of foreseeable events. If both spouses are employed by the same state agency, Family Leave may not be taken at the same time, and leave taken by both spouses may not exceed a combined total of 12 weeks.
